Here\u2019s How to Maximize Privacy in Your Offshore Transactions<\/strong><\/h2>\n

Question<\/strong>: \u201c<\/span>How can I maximize privacy in my offshore transactions<\/span><\/i>?\u201d<\/span><\/p>\n

This question can be broken down into two parts: <\/b><\/h3>\n
    \n
  1. Privacy from governments and the tax authorities, and<\/span><\/li>\n
  2. Privacy from future civil creditors. <\/span><\/li>\n<\/ol>\n

    The first of these, <\/span>privacy from the taxman<\/span><\/i>, can be disposed of quickly: <\/span>it no longer exists<\/b>. <\/span><\/p>\n

    Up until about 1995, the very rich could open numerous accounts in the Cayman Islands and Switzerland. The bank had no idea who the beneficial owner of the money was and would not disclose your private details, no matter who came knocking. <\/span><\/p>\n

    These are the accounts of legends, which became famous in books such as <\/span>The Firm<\/span><\/i> and movies including nearly all of the James Bond characters. <\/span><\/p>\n

    Walk in with a suitcase of cash and walk out with a secret code and your money safely hidden from everyone. <\/span><\/p>\n

    Secret numbered accounts <\/span>were done away with<\/i><\/b> in the 1990s as governments targeted terrorist financing and drug dealers. <\/span><\/p>\n

    And privacy in financial dealings has been <\/span>eroding since 2000<\/i><\/b> when the U.S. government went on the offensive against tax cheats.<\/span>
    \n<\/a><\/p>\n

    In 2017, All Privacy is Gone from Offshore Transactions <\/b><\/h3>\n

    If you\u2019re a U.S. citizen, foreign banks report your accounts and transactions to the U.S. IRS under the Foreign Account Tax Compliance Act (FATCA). Most other countries, including the European Union, have adopted or are in the process of implementing similar measures. \u00a0<\/span><\/p>\n

    To repeat, <\/span>no one should expect financial privacy from their government<\/span><\/i> in offshore transactions. <\/span><\/p>\n

    It has become impossible to hide money from the taxman, so don\u2019t even try.<\/span>

    That\u2019s the Bad News. Now, Here\u2019s the Good <\/b><\/h3>\n

    You can achieve privacy in offshore transactions<\/a> and protect your assets from <\/span>civil<\/span><\/i> creditors. <\/span><\/p>\n

    Specifically, you can protect your assets from <\/span>future<\/b> civil creditors. <\/span><\/p>\n

    Privacy in offshore transactions comes from setting up a structure in such a way that no one can determine the owner. That is, forming an offshore corporation, LLC or trust in a country that doesn\u2019t maintain a public registry or searchable database that reflects the officers, directors, or settlor. <\/span><\/p>\n

    And, if you do use a structure in a country with a public registry, you can add-on offshore companies to hide the officers, directors and settlors from public view. <\/span><\/p>\n

    Remember, we\u2019re talking about <\/span>civil creditors<\/b> here. U.S. citizens will be required to report their ownership of any offshore structure to the IRS, and your foreign bank will report your transactions.<\/span>

    Some of the Best Privacy in Offshore Transactions is Found in Smaller Jurisdictions<\/b><\/h3>\n

    For example, I often recommend Belize, Nevis, Cook Islands<\/a>, and others. These countries do not have a public registry and are thus more efficient for those seeking privacy. <\/span><\/p>\n

    But, sometimes you need a bank or merchant account in a country that has a public registry. <\/span><\/p>\n

    For example, Panama has become a major financial center over the last decade, <\/span>but all officers and directors are public record<\/span><\/i>. <\/span><\/p>\n

    Back in the day, you could use nominee officers and directors, or set up a bearer share company in Panama. Bearer shares went out a few years ago and I never recommend nominee officers in an offshore corporation. <\/span><\/p>\n

    Nominee directors in a country like Panama have little or no power. They can\u2019t bind the company and can\u2019t access the bank accounts. <\/span><\/p>\n

    On the other hand, officers are usually the signatories to the bank accounts and therefore control the purse strings. <\/span><\/p>\n

    There is a <\/span>safe solution to maximize privacy<\/b> in an offshore transaction involving a Panama structure:<\/a> the officers and directors of a Panama corporation can be persons or entities (corporations, trusts, LLCs, etc.). <\/span><\/p>\n

    We can form an LLC in a country that doesn\u2019t have a public registry, such as Belize, and use that company as the officer for your Panama corporation. When someone searches the Panama database, all they see is the name of your Belize LLC, which is a dead end. <\/span><\/p>\n

    When we open your bank account, the bank will get your Panama corporate documents and your Belize LLC forms, which prove you are the rightful owner of the structure. You will be the only signer on the bank account, which protects your cash from nominees. <\/span><\/p>\n
